Please send us your request in accordance with section 6 in writing, enclosing an official identification document with the keyword "data protection".
4. Purposes of data processing
4.1. General data processing
The usage data collected, stored and processed by Jansen may be processed for the following purposes:
- to the extent necessary to manage the customer relationship, provide services, process orders and contracts, provide billing, respond to questions and concerns, provide technical support, and evaluate, improve and develop new Jansen products, services, and features.
- if you have consented to this when using a product, service or function. You provide us with most data voluntarily and on your own accord, in particular when submitting inquiries or orders, entering into contracts, and logging in to non-public areas of our website.
- to the extent necessary to secure our technical infrastructure, maintain cybersecurity and ensure quality of service. Such data is often technical in nature and is usually collected automatically (e.g. your IP address). We do this because we have a legitimate interest in providing, improving and expanding our website, content, and services in the most error-free and user-friendly manner possible.
- if this is necessary to comply with a legal obligation (e.g. to comply with a court order or to prevent or detect a crime). The relevant legal obligation then serves as the legal basis.
- And beyond this, to the extent set forth below in this statement.
4.2. Data processing for marketing purposes
Jansen may also collect and process your personal data for marketing purposes, although not all categories of data are always actually collected.
Jansen creates customer segments in order to provide you with customized advertising. To this end, we analyze the data required for this marketing purpose.
As part of our marketing activities, we may make your data available to the employees of Jansen AG's subsidiaries and representative offices. In particular, these are:
RP Technik GmbH Profilsysteme
Jansen AG Representative Office NL/BE
The same rule applies to Jansen's sales partners.
You hereby agree that the subsidiaries and representative offices of Jansen AG and its sales partners may receive data from Jansen for advertising purposes and may also use this data for marketing purposes.
4.3. Data analysis
Jansen uses data analysis to collect analytical and statistical information. This data is collected in an anonymous form. Any further use of the data will be based on further consent only to the extent required by law.
4.4. Newsletter
You have the option of subscribing to our newsletter. For this purpose, Jansen requires your first name, last name, address (private and/or business) and email address (private and/or business) as well as your declaration that you agree to receive the newsletter. Once you have subscribed to the newsletter, you will receive a confirmation email with a link to confirm your subscription.
Jansen uses this to log the subscription to the newsletter, the sending of a confirmation email and the receipt of the requested response. The data will only be used to send the newsletter and will not be passed on to third parties. In order to provide you with targeted information, Jansen also collects and processes information you voluntarily provide about your industry and function. Subscribers may also be notified by email about circumstances relevant to the service or registration (e.g. changes to the newsletter offering or technical circumstances).
You can cancel your subscription to non-business information at any time. You will find a link to do so in each newsletter. Jansen will then delete the data you have provided in connection with the sending of the newsletter.
4.5. Legal basis
We process personal data in accordance with Swiss data protection legislation.
If and insofar as the EU GDPR is applicable, we also process personal data in accordance with Art. 6 (1) lit. a) - d), f) of the General Data Protection Regulation (GDPR).
5. Duration of storage
Jansen stores and processes your personal data for as long as is necessary to achieve the purpose of the processing or for as long as there is a legal basis for doing so or Jansen has a legitimate interest in doing so (e.g. to protect against misuse of our website or to restore our systems).
We will retain data that Jansen holds on the basis of a contractual relationship with you at least as long as the contractual relationship exists and limitation periods for possible claims by us or statutory or contractual retention obligations exist. A 10-year retention period applies to most data in this regard (e.g. for contracts and invoices).
Your personal data will then be deleted from our systems or made anonymous so that it cannot be identified at a later date.
6. Your privacy rights
You have the right to receive information and confirmation about the personal data we hold about you. This right is generally free of charge. We reserve the right to charge for responding to abusive requests for information.
You also have the right to request the correction of your personal data and, unless this is not technically possible or the storage of data is required by law, the deletion of your personal data. You may also request that your information be locked. However, in order for a data lock to be considered, this data must be kept in a lock file for control purposes.
You also have the right to restrict processing and, where technically feasible, the right to data portability.
You have the right to withdraw your consent to the processing of your personal data. Withdrawal of consent does not apply retroactively and cannot apply to the general display of advertising by Jansen (e.g. on the Internet).
Please note that the aforementioned rights may be limited or excluded in individual cases, e.g. if there is doubt about your identity, if it is necessary to protect other persons, to safeguard interests worthy of protection, or to comply with legal obligations.
In principle, you have the right to lodge a complaint with the competent supervisory authority regarding data processing. The competent supervisory authority is the Federal Data Protection and Information Commissioner (FDPIC).
7. Forwarding of data
7.1. General
Jansen only shares data with third parties to the extent described below, and we always strive to minimize the exchange of data.
Requests from authorities will be responded to in accordance with the applicable laws, provided that they are authorized and have the appropriate warrants.
7.2. Provision of services and goods
If Jansen provides services or goods to you jointly with third parties, Jansen may disclose data to third parties that is necessary to provide the service or goods. This applies in particular to the following providers:
7.2.1. Web analytics tools
Jansen uses various third-party web analytics tools to evaluate your use of our website, to compile reports on website activity and to provide other services relating to website and Internet usage to the website operator. If necessary for their activities, these third parties may access and process personal data stored by Jansen from abroad. The recipient of the collected data is the respective third-party provider of the web analytics. The third party's servers may be located abroad.
The recipients of your personal data may also be located abroad, including outside the European Economic Area ("EEA"; consisting of the member states of the EU and EFTA with the exception of Switzerland). The countries concerned may not have laws that protect your personal data to the same extent as in Switzerland, the EU or the EEA. If we transfer your data to such a country, we will ensure the protection of your personal data in an appropriate manner, for example through corresponding contractual agreements with these recipients.
The following tracking technologies are used on our websites:
- Matomo
- Google Ads
- Google Maps
- Meta Pixel
- Kibana
- Friendly Captcha
Matomo
We use the web analytics service software Matomo (https://matomo.org), a service provided by InnoCraft Ltd., 150 Willis Street, 6011 Wellington, New Zealand, ("Matomo") on our website and on our direct subpages. Matomo can be used to create and evaluate pseudonymized user profiles. Cookies can be used for this purpose. Among other things, cookies allow the Internet browser to be recognized. The data collected using Matomo technology (including your pseudonymized IP address) is processed on our servers. The information generated by the cookie in the pseudonymous user profile is not used to personally identify the visitor to this website and is not merged with personal data about the bearer of the pseudonym. Matomo is used for statistical analysis of user behavior for optimization and marketing purposes. This is also in our legitimate interest.
The IPv4 address is shortened by the last two bytes for storage and processing and is therefore anonymized.
In order to recognize returning visitors, a cookie is stored on the user's system during a visit (if possible), which contains the following data:
- Randomly generated unique user ID
- Time of the first visit of this user ID
- Time of the last visit of this user ID
- Total number of visits by this user ID
The assigned ID is random and does not allow any conclusions to be drawn about the person acting. The cookie has a lifespan of 7 days, which is extended by an additional 7 days for visits within that period.
During a visit, each visitor is assigned a random ID by means of their session cookies (if possible), by means of which all actions on the website can be associated with this visitor. The cookie is usually deleted automatically when the browser window is closed. The default setting, which automatically deletes session cookies either when the tab is closed or when the browser is closed, can be overridden manually or by using certain convenience features.
This so-called tracking can be prevented by the do-not-track setting in most browsers. This setting has the effect that the "do-not-track" tag is also sent in the header block of the browser request and the visitor's actions are not evaluated.
More information can be found in Matomo's detailed privacy statement: https://matomo.org/privacy/
Google Ads
We use the online marketing tool Google Ads (https://ads.google.com/intl/en/home/) on our website and on our direct subpages; it is a service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google Ads"). Google Ads uses cookies to show ads that are relevant to users, to improve campaign performance reports or to prevent a user from seeing the same ads more than once. Google uses a cookie ID to record which ads are shown in which browser and can thus prevent them from being shown more than once. In addition, Google Ads can use cookie IDs to track so-called conversions, which are related to ad requests. This is the case, for example, if a user sees a Google Ad and later accesses the advertiser's website with the same browser and buys something there. According to Google, Google Ads cookies do not contain any personal information.
Based on the marketing tools used, your browser automatically establishes a direct connection with Google's servers. Google Ads will notify Google that you have visited the relevant part of our website or clicked on an advertisement on our website. If you are signed in to a Google service, Google can associate the visit with your account. Even if you are not registered with Google or have not logged in, there is a possibility that Google will learn and store your IP address.
You can opt out of this tracking process in various ways:
- by adjusting your browser settings accordingly; in particular, blocking third-party cookies means that you will not receive ads from third-party providers;
- by disabling cookies for conversion tracking by adjusting your browser settings to block cookies from the domain “https://ads.google.com”, via https://adssettings.google.com/anonymous?hl=en; this setting will be deleted when you delete your cookies;
- by disabling the interest-based ads from the providers that are part of the "About Ads" self-regulation campaign at https://www.aboutads.info/choices; this setting will be deleted when you delete your cookies;
- by permanent disabling in your Firefox, Internet Explorer or Google Chrome browsers via https://www.google.com/settings/ads/plugin. We would like to point out that in this case you may not be able to use all the functions of this website to their full extent.
The legal basis for the processing of your data is a balancing of interests, according to which the processing of your personal data as described above does not conflict with any overriding interests on your part (Art. 6 para. 1 sentence 1 lit. f GDPR). For more information about Google Ads from Google, please visit https://ads.google.com/intl/en/home/, and for more information about Google's privacy practices in general, please visit: https://www.google.de/intl/en/policies/privacy. Alternatively, you can visit the website of the Network Advertising Initiative (NAI) at https://www.networkadvertising.org.
Google Maps
We use Google Maps to embed maps. An interface (API) is used to connect to the servers of Google Ireland Ltd. As a minimum, the IP address, URL (Internet address) of our website and the date and time of use are transmitted to Google. The legal basis for their transmission is our agreement with Google Ireland Ltd. (https://www.google.com/intl/en_US/help/terms_maps/) pursuant to Art. 6 para. 1 lit. b) GDPR in conjunction with a joint responsibility agreement pursuant to Art. 26 GDPR, which you can access here: https://business.safety.google/intl/en/controllerterms/.
When you visit the website, Google is notified that you have accessed the corresponding subpage of our website. This happens regardless of whether Google provides a user account that you use to sign in, or whether no user account exists. If you are logged in to Google, your data will be directly associated with your account. If you do not wish to be associated with your Google profile, you must log out before clicking the button. Google stores your data as usage profiles and uses them for the purposes of advertising, market research and/or the needs-based design of its website. Such an evaluation is carried out in particular (even for users who are not logged in) to provide needs-based advertising and to inform other users of the social network about your activities on our website. You have the right to object to the creation of these user profiles, and you must contact Google to exercise this right. For more information on the purpose and scope of data collection and processing by Google, as well as information on your rights and settings to protect your privacy, please visit: https://policies.google.com/privacy?hl=en-US.
Meta Pixel
Our website uses the so-called "Meta Pixels" provided by Meta, which is operated by Meta Platforms, 1 Hacker Way, Menlo Park, CA 94025, USA, or, if you are based in the EU, Meta Platforms Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland ("Meta").
With the help of the Meta Pixels, Meta is able to identify you as a visitor to our website as a target group for the display of advertisements (ads). Accordingly, we use the Meta Pixel to display the Meta ads we serve only to users of Meta platforms who have also shown an interest in our online offerings or who have certain characteristics (e.g. interest in certain topics or products determined on the basis of websites they visit) that we provide to Meta (so-called "custom audiences"). We also want to use the Meta Pixel to ensure that our Meta ads are relevant to the potential interest of users and not annoying. We can also use the Meta Pixel to track the effectiveness of Meta ads for statistical and market research purposes by seeing whether users were redirected to our website after clicking on a Meta ad (so-called "conversion").
Kibana
Kibana is an analytics tool that is used when the Jansen Docu-Center is used. Log analytics are used for this.
The following data can be stored and monitored:
- User (login)
- Country assignment & permissions (AR/KU etc.)
- Logins (frequency)
- Catalog/video views
- Search terms
Friendly Captcha
On our website we use the "Friendly Captcha" for bot / spam protection, which is operated by Friendly Captcha GmbH, Am Anger 3-5, 82237 Wörthsee, Germany.
When you click on the button in the contact form area, your end device solves a calculation task and sends the calculation result to our web server. This contacts the Friendly Captcha server via an interface and receives a response as to whether the puzzle has been solved correctly by the end device. Depending on the result, we can assign security rules to requests via our website and, for example, process or reject them.
The data is used exclusively to protect against spam and bots as described above. Friendly Captcha does not set or read any cookies on the visitor's end device. IP addresses are only stored in hashed (one-way encrypted) form and do not allow us or Friendly Captcha to draw any conclusions about an individual person. Only the hash value is stored on the Friendly Captcha server for a maximum of 30 days and then deleted.
Further information on data protection when using Friendly Captcha can be found at https://friendlycaptcha.com/legal/privacy-end-users/.
7.2.2. Social media plug-ins
On our website and in our communications with you, we use simple links to the social networks Instagram, Facebook, LinkedIn, Pinterest and YouTube, which can be identified by the logo of the respective network. All plug-ins used are set up using the 2-click method. This means that you must first click on the logo or icon of the respective provider to activate it. If you click on the icon, you will leave our website. Additional data may be collected if you are logged in to the linked social media service. Additional information on the scope and purpose of the collection and use of data, as well as your rights and options for protecting your privacy in this regard can be found in the data protection notices of the respective platforms.
References and links to third-party websites are beyond our area of responsibility. Any responsibility for such websites is disclaimed. Access to and use of such websites is at the user's own risk.
Facebook
Our website and communications with you use features provided by Facebook Inc, 1601 S. California Ave, Palo Alto, CA 94304, USA. When you visit our pages using Facebook plug-ins, a connection is established between your browser and the Facebook servers. Data is already being transmitted to Facebook at this point. If you have a Facebook account, this data can be linked to it. If you do not want this data to be linked to your Facebook account, please log out of Facebook before visiting our site. Interactions, in particular using a comment feature or clicking a "Like" or "Share" button, are also sent to Facebook. You can find out more at https://www.facebook.com/privacy/policy/.
Instagram
Features provided by Instagram are integrated on our website and into our communications with you. These features are provided by Instagram Inc., 1601 Willow Road, Menlo Park, CA, 94025, USA. If you are logged into your Instagram account, you can link the content of our pages to your Instagram profile by clicking on the Instagram button. This allows Instagram to associate your visit to our pages with your user account. We would like to point out that, as the provider of the pages, we have no knowledge of the content of the transmitted data or its use by Instagram. Additional information can be found in Instagram's privacy policy: https://instagram.com/about/legal/privacy/.
LinkedIn
Within our online offering and in our communications with you, we use the marketing services provided by the social network LinkedIn of LinkedIn Ireland Unlimited Company, Wilton Plaza, Wilton Place, Dublin 2, Ireland ("LinkedIn").
These marketing services use cookies, i.e., text files stored on your computer. This allows us to analyze your use of the website. For example, we can measure the success of our advertising and show users products that they were previously interested in.
For example, information is collected about the operating system, the browser type, the website previously visited (referrer URL), the websites visited, the advertisements clicked on, and the date and time of your visit to our website.
The information generated by the cookie about your use of this website is transmitted in a pseudonymous form to a LinkedIn server in the United States and stored there. LinkedIn therefore does not store the name or email address of any individual user. Rather, the aforementioned data is only associated with the person for whom the cookie was created. This does not apply if the user has given LinkedIn permission to process the data without pseudonymization or has a LinkedIn account.
You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website. You may also opt out of the use of your data directly with LinkedIn: https://www.linkedin.com/psettings/guest-controls/retargeting-opt-out.
We use LinkedIn Analytics to analyze and regularly improve the use of our website. The statistics obtained allow us to improve our offering and make it more interesting for you as a user. All LinkedIn companies have adopted the standard contractual clauses to ensure that the data transfers to the United States and Singapore, which are necessary for the development, implementation and maintenance of the services, are carried out in a lawful manner. If we ask users for their consent, the legal basis for the processing is Art. 6 (1) lit. a GDPR. Otherwise, the legal basis for the use of LinkedIn Analytics is Art. 6 para. 1 sentence 1 lit. f GDPR.
YouTube
Features provided by "YouTube" are integrated on our website and into our communications with you. "YouTube" is owned by Google Ireland Limited, a company incorporated and operating under Irish law with its registered office at Gordon House, Barrow Street, Dublin 4, Ireland, which operates the services in the European Economic Area and Switzerland.
Your legal agreement with "YouTube" consists of the terms and conditions that you can find at the following link: https://www.youtube.com/static?template=terms. These terms and conditions constitute a legally binding agreement between you and "YouTube" regarding your use of the services. Google's privacy policy explains how "YouTube" handles and protects your personal data when you use the service.
7.2.3. Communications and office applications
We use audio and video conferencing services to communicate with our users and others. In particular, we can use them for audio and video conferencing, virtual meetings, and training such as webinars.
In particular, we use Microsoft applications to communicate with you, e.g. MS Office 365 applications such as Outlook, Word, Excel, PowerPoint, Teams and SharePoint. In addition to this privacy statement, the terms and conditions of the services used, such as terms of use or privacy statements, also apply, which provide information on what data is transferred, how it is used and what measures are taken when data is transferred abroad, in particular to the United States (e.g. encryption, order processing contracts, standard contractual clauses, privacy impact assessment, certifications). Further information can be found at Microsoft: privacy.microsoft.com/en-gb/privacystatement
7.2.4. Data security measures
Data security is a key concern for Jansen. Jansen therefore maintains a number of technical measures to reasonably ensure the security of your data in order to protect it from unauthorized or unlawful processing, loss or unintentional alteration, unwanted disclosure or unauthorized access. Against this background, data is exchanged in the following cases:
SSL/TLS encryption
Our website uses SSL/TLS encryption. You can recognize an encrypted connection when the address bar of your browser changes from "http://" to "https://" and when the lock icon appears in your browser bar.
If SSL or TLS encryption is activated, the data you transfer to us cannot be read by third parties.
Server log files
The provider of our website automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:
- Browser type and browser version
- Operating system used
- Referrer URL
- Hostname of the accessing computer
- Time of the server request
This data cannot be associated with specific individuals. This data is not merged with other data sources. We reserve the right to check this data retroactively if we become aware of specific indications of unlawful use.
8. Data processing abroad by contracted third parties
As described above, Jansen provides some services and products to you together with third parties or relies on the assistance of third parties abroad to provide services and products. If necessary for their activities, such third parties may access and process personal data stored by Jansen from abroad. The data stored by Jansen may also be stored on servers abroad and processed by third parties.
By using the Jansen website (https://www.jansen.com), its content and services and by accepting this privacy statement, you give Jansen your consent to the collection, storage, processing and transfer of data to third parties, if necessary also abroad, within the scope of appropriateness and necessity. In principle, transfers abroad are only carried out in accordance with the provisions of sections 4.2 and 7.
If a data recipient is located in a country without an adequate level of data protection, Jansen will undertake efforts to contractually obligate the recipient to comply with the applicable data protection regulations, for example by concluding order processing contracts or applying standard contractual clauses. This does not apply to data recipients already subject to a legally recognized set of rules to ensure data protection and where Jansen can invoke an exemption provision.
9. Cookies
Our website uses cookies. Cookies are text files that are stored on your end device using your browser. They do not cause any damage. We can use the information contained in the cookies to make navigation easier for you and to enable the correct display of our web pages. Under no circumstances will the data we collect be shared with third parties or linked to personal data without your consent. Some cookies remain stored on your end device until you delete them. These stored cookies allow us to recognize your browser on your next visit and to make your visit to the Jansen AG website efficient and user-friendly. If you do not want this to happen, you can set up your browser to notify you when cookies are set and only allow this on a case-by-case basis. If cookies are disabled, the functionality of certain elements of our website may be limited.
Cookies collect usage information such as the IP address of your device, the date and time of access, the name and URL of files accessed, the website from which access was made or from which you were directed to our site (referrer URL), the browser used and, if applicable, the operating system of your device, and the name of your provider.
You can revoke your consent at any time with effect for the future by preventing the storage of cookies by setting your browser software accordingly. A general opt-out of the use of cookies for online marketing purposes, especially in the case of tracking, can be exercised for a large number of services via the US website https://www.aboutads.info/choices/
or the EU website www.youronlinechoices.com. You can also disable the storage of cookies in your browser settings. Please note that in this case not all features of this online service can be used. However, we would like to point out that in this case you may not be able to use all the functions of our website to their full extent. You can also prevent Google from collecting and processing the data generated by the cookies and relating to your use of the website (including your IP address) by downloading and installing the browser add-on. Opt-out cookies prevent your data from being collected in the future when you visit this website.
